today my girlfriend and I had to go over to walmart ,well when we pulled
in, there was actually someone that was holding up traffic flow by at
least 7 car lengths in the parking lot just so they could get spot right
on the end by the doors of the store well after they got pulled thru we
could finally go up the first row and we got a spot maybe 150 feet away
from the store
then as we went in I actually saw some indecent POS pull into a handicap
spot with no tag in windshield or handicap plates on the vehicle and the
driver and the passenger literally jumped out of their SUV and walked
right into the store and all I could think of is now what if there is a
fellow biker or one of our veterans that is now have to be in a
wheelchair comes in and can't find a spot and have to park on the
outside of the lot all because some indecent POS that has nothing wrong
with them took a spot meant for them ,it makes sick at times IMHO
whats your HO

walk????

You're in the wrong profession. Medical diagnostics can always use someone
like you.

My wife has congestive heart failure, and has a handicap tag from the
Registry of Motor Vehicles.

She doesn't limp or anything like that, but she IS handicapped and limited
in how far she can walk. (Google CHF - you might learn something about
debilitating conditions)

YOU could not spot it unless you followed her for a distance and saw her
gasping for breath.

Walking from the handicap spot to the store does NOT reveal her handicap,
but I can assure you that she DOES have a legitimate reason for that
parking place.

I try not to assume things... and I never said one can always spot the
handicaps with eyeballs duffus. Stop putting words in my mouth then accusing
me of things "you" say! I've seen and confronted many persons and legitimate
handicap folks don't mind telling anyone what is wrong with them instantly
and in a matter-of-fact way.

Last time it happened in front of a super market I frequent, I asked the
young man as he RAN out of the store carrying groceries what his handicap
was and he stuttered and didn't answer. I asked again and he said "Look at
the tag!". I said "I see the tag, what's it for?" and he just ignored me and
got in his car. Obvious abuser of the privilege.

And before you go off half cocked again, there are exceptions to all things
from the abuser who has no handicap to the person who fakes a handicap and
gets a sticker or plate for faking. The vast majority are probably
legitimate, but the ones that "YOU could not spot" easily are predominantly
illegitimate in my experience.

I don't care if you're wearing your Village People uniform........

.......if a check with the Registry of Motor Vehicles shows that the serial
number on the handicap tag on the car has, indeed, been issued to my wife -
and it has - her health and medical history is absolutely NONE OF YOUR
BUSINESS!!!!

Such information is subject to doctor/patient confidentiality laws...

You may ask for her license and registration - which she would gladly
supply to ANY legitimate peace officer, but her health and medical history
is off-limits to you, Bub!

How much clearer can I make that?

Go ahead and give her a hard time - force the issue - and let's see what
court will not side with her.......and, maybe, suggest you pursue a
different line of work!

So, why didn't you use your "DTS" authority, detain him, and ask for his
license and insurance - much the same as you have threatened to do to me
should I enter your neighborhood????

Geez....isn't ignoring a REAL police officer some sort of offense???

here in PA it is illegal to use a handicap windshield tag without that
person in the car .and under the federal law the store management is
required to have the handicap parking spot and also is allowed to
enforce it's use by to verify that the person parking there has the
handicap and what the handicap they suffer if he suspects they are not
the owner of the tag to verify the use of it for the person ,and if they
refuse he is allowed to call the police and they will findout if that
tag is legitimate or not and if the said person is not the legitimate
owner the police have the right to impound the vehicle at owners expense
and the person can be charged with fraud which is a felony and could
face jail time .
For your info unless they have the tag they still cannot park there even
if they do have a handicap unless they have been issued from the state
the tag for it for a doctor does not recogonize the person as having a
limiting physical condition needing to park in the handicap spot, so if
you don't have one or can't get it is because your doctor does not feel
you meet certain physical conditions to merit the issue of said tag.

I am so sorry about this whole flame now but I just wanted to bring
these people to attention ,yes calling the police is the right thing to
do to report a possible infraction like that and to notify the manager
is also another one to notify ,plus if you happen to have a digital
camera with you take a picture of the vehicle fthe side to id it from
the front to show no tag in windshield and from the rear to show the
tags and to show it was parked in a handicap spot ten if they leave you
can give the police at least the license number for them to check it out
and if they cannot verify it is a good chance they will have a date in
court to try to prove they needed to be in there
I'm sorry for the trouble and apologize for all the flaming that had to
happen

Personally, I dont think you have anything to apologize for.


Our American public should speak up when unacceptable
behavior, in this case a misdemeanor crime, is committed.

We have looked the other way and tolerated trash behavior
for far far too long.

In this state, if you whip out your pepper spray, you could be arrested for
assault with a deadly weapon, whether or not you use it. If a private
citizen tries to ask you a question, you don't have any obligation to
answer, but you have no legal right to brandish a 'weapon'.

If you use it, your rump can end up in jail (which is fairly easy), or on
the
end of a civil suit (which isn't).

I fully appreciate your wife's desire to protect herself, but if she goes on
the offensive, you can end up in a heap of trouble.

There probably isn't a law student in the world - let alone a full-fledged
lawyer - who could not get this thrown out of court.

Digital photos can be manipulated in so many different ways that - with the
right software - you could probably produce a photo of Santa's sleigh
parked in a handicap spot.

Dumb idea......

Call a cop.....period.

If you are NOT a cop, don't try to enforce the law yourself.
